Position Summary

The Chief Compliance and Fair Practices Officer (CCFPO) ensures compliance with statutory, regulatory, and policy matters that impact the college, including federal and state laws and regulations. Reporting directly to the President, the CCFPO provides independent oversight and coordination of an institutional compliance program that promotes a culture of compliance and the highest standards of ethics, integrity, and responsibility within the College community. By partnering with leaders and staff across compliance-intensive areas, the CCFPO provides strategic leadership and collaborative oversight of all compliance-related activities for the College.

Job Duties and Responsibilities

Policy Management & Institutional Governance
• Oversees the development, revision, maintenance, and discontinuation of College policies, procedures, and the College Manual.
• Works with vice presidents, faculty, and staff governance bodies, and policy owners to ensure the College maintains a comprehensive and compliant set of policies and procedures.
• Establishes and maintains a centralized policy library or repository of official College policies and procedures.
• Working with Strategic Communications ensures that public-facing communications (e.g., the website) reflect current policies, procedures, and laws.

Title IX, EEO, and Civil Rights Compliance
• Serves as the College’s Title IX Coordinator and EEO Coordinator, and primary contact for complaints related to the AACC Equal Opportunity and Nondiscrimination Policy.
• Exercises primary responsibility for Title IX compliance, including overseeing internal and external investigators and campus-wide training on rights and responsibilities.
• Works closely with the Office of Community Standards to ensure consistency in reporting options, student rights, and responsibilities.
• Initiates and oversees investigations related to suspected violations of civil rights laws, including Titles VI and VII, Title IX, ADA, Section 504, and ADEA.
• Refers complex or legal matters to appropriate College offices or General Counsel, as needed.

External Agency Liaison & Regulatory Monitoring
Serves as the institutional liaison to the Maryland Commission on Civil Rights (MCCR), Equal Employment Opportunity Commission (EEOC), and Office for Civil Rights (OCR) and prepares position statements and other filings with such agencies, as required.
• In consultation with the President and College Counsel, monitors, advises, and responds to complaints filed with external entities, such as MHEC and the Middle States Commission on Higher Education.
• Is responsible for preparing:
o Alcohol and Other Drug Program Report
o MHEC Sexual Climate Survey and Incident Report
o Athletics Student Grievance Report
o Heroin and Opioid Prevention Education Report
• Stays abreast of legal and regulatory developments, interpreting their impact and ensuring relevant personnel are informed and trained.
• Consults with leadership to mitigate compliance risks while balancing administrative burden.

Compliance Training & Risk Mitigation
• Monitors internal and external compliance environments to identify risks and vulnerabilities.
• Advises departments on managing compliance responsibilities tied to their roles.
• Partners with HR and the Center for Professional Development to ensure consistent compliance training for new hires and continuing employees.

Ethics & Financial Disclosure
• Serves as the Ethics Commission Liaison, managing documentation and compliance with Maryland State Ethics Commission requirements.
• Tracks and monitors financial disclosure submissions, notifies filers, and updates the Commission on staffing changes.

Affirmative Action & Equity Reporting
• Serves as the Affirmative Action Officer; maintains the College's Affirmative Action Plan.
• Reviews and analyzes affirmative action data and recommends action plans to leadership.
• Collaborates with Human Resources and the Chief Diversity Officer to implement approved plans.

Supervision & Oversight
• Supervises the College’s ADA Accessibility and Compliance Officer

Required Qualifications:

Juris Doctorate is required.

License to practice law in Maryland

A minimum of 10 years of experience with compliance program development, implementation, complaints, and investigations, and general higher education experience.
Of the total 10 years, a minimum of 2-4 years in higher education or related experience, including direct experience with Title IX, required.

Strong problem-solving & conflict resolution skills, including the ability to anticipate issues and concerns whenever possible.

Current working knowledge of local, state, and federal legislation governing compliance, including Title IX, Title VI, Title VII, VAWA, and Clery Act.

Strong and effective interpersonal skills; the ability to listen well and demonstrate sensitivity to and respect for individual needs. The ability to respond with equanimity to crisis and highly sensitive situations, and excellent listening, communication, and presentation skills.

Preferred Qualifications:

Credential as a trained mediator.

Experience reporting to a senior counsel, senior partner, College president, or other high-level administrator.

Experience in employment law is preferred.

Pay dates occur on the 7th and 22nd of each month. If those dates fall on a weekend, the pay date occurs on the Friday prior to the 7th and 22nd. As an employee of the college, you are eligible for a comprehensive benefits package.

In the best interest of the College, only individuals who are residents of Maryland or one of the following states will be eligible for employment at the college: Delaware, Pennsylvania, Virginia, West Virginia or the District of Columbia. The college will annually review this restriction and, if appropriate, expand the list of states of employment eligibility
